Terms & Conditions

1. Acceptance

If you do not agree, do not use Sunka. If you use Sunka on behalf of a business, you confirm you have authority to bind that business. Google Play / App Store terms also apply to app distribution; nothing in those store terms overrides our right to set service rules for Sunka accounts.

2. Accounts & eligibility

• You must provide accurate registration information and keep it up to date.
• You must be at least 18 years old (or the age of majority where you live) to create an account. Some features (e.g. age-gated marketplace items) may require additional confirmation.
• You are responsible for safeguarding login credentials, OTPs, and devices. Notify us promptly of unauthorised access.
• One person should not maintain multiple accounts to evade bans, ratings, or fees.

3. Services

Sunka is a technology platform that connects customers with independent drivers, restaurants, sellers, and other partners. Unless we expressly say otherwise, we are not the transportation carrier, restaurant, retailer, or landlord for marketplace/property listings. Availability of features varies by city and may change. We may introduce beta features that are provided “as is”.

4. Customer rules

• Provide accurate pickup/drop-off and contact details for rides and deliveries.
• Treat drivers and partners respectfully; do not damage vehicles or property.
• Pay fares, tips, and order totals as shown (including applicable fees and taxes).
• Do not request illegal transport of prohibited goods or misuse SOS features.
• Grant device permissions (location, notifications, etc.) only if you want the related features; see the Privacy Policy for details.

5. Driver & partner rules (Sunka Pro)

• You must hold all licences, permits, insurance, and vehicle fitness required by law in Lusaka, Zambia (and any city where you operate).
• Upload truthful verification documents. Fraudulent documents may lead to permanent ban and reporting to authorities.
• While online, keep location and trip-alert permissions enabled as required so dispatch and riders receive accurate ETAs. Background location is used for matching only while you are online for work.
• Accept only trips you can complete safely; follow traffic laws; do not drive under the influence.
• You are an independent contractor unless a written employment agreement says otherwise. You are responsible for your taxes and operating costs.
• Commissions, incentives, and payout schedules are described in-app or in partner agreements and may change with notice.

6. Payments, fees & refunds

• Prices may include base fare, distance/time, surge, delivery fees, service fees, and taxes as disclosed before you confirm.
• Payment methods may include cash, mobile money, cards, or wallet balance, depending on market.
• Refunds, cancellations, and no-show fees follow the policy shown at checkout or in the relevant product flow. Chargebacks filed in bad faith may lead to account action.
• Promotional credits have conditions and may expire.

7. User content & listings

You retain ownership of content you upload (photos, listing text, chat). You grant Sunka a worldwide, non-exclusive licence to host, display, and use that content to operate and promote the services. Marketplace, property, and automotive listings must be lawful, accurate, and yours to sell/rent. We may remove content that violates these Terms or law.

8. Prohibited conduct

• Illegal activity, fraud, money laundering, or abuse of promotions.
• Harassment, hate speech, sexual exploitation, or threats.
• Scraping, reverse engineering, interfering with security, or automated account creation.
• Impersonation, fake ratings, or manipulating dispatch.
• Uploading malware or content that infringes others’ rights.

9. Safety & SOS

Safety tools (trip sharing, SOS, support chat) assist but do not replace emergency services. In an emergency, contact local authorities first. Misuse of SOS may result in account suspension.

10. Intellectual property

Sunka branding, software, and content (excluding user content) are owned by Sunka Technologies limited or its licensors. You may not copy, modify, or distribute them except as allowed by these Terms or written permission.

11. Disclaimers & limitation of liability

Services are provided on an “as available” basis. To the fullest extent permitted by law, we disclaim warranties of uninterrupted availability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, or consequential damages, or for the acts/omissions of independent drivers, restaurants, or sellers. Our aggregate liability arising out of your use of Sunka is limited to the greater of (a) fees you paid to us for the transaction giving rise to the claim in the 3 months before the claim, or (b) USD 50 (or local equivalent), except where liability cannot be limited by law (e.g. death or personal injury caused by negligence, or fraud).

12. Suspension & termination

You may stop using Sunka at any time. We may suspend or terminate accounts that violate these Terms, create safety risk, or for operational/legal reasons. Outstanding payment obligations survive termination.

13. Governing law & disputes

These Terms are governed by the laws of Zambia, without regard to conflict-of-law rules. Courts in Lusaka, Zambia have exclusive jurisdiction, except where mandatory consumer protections require otherwise. Contact [email protected] first so we can try to resolve disputes informally.
